These Terms of Service ("Terms") govern your use of the website jhimjham.tech (the "Site") and the purchase of services from Jhimjham LLC ("Jhimjham", "we", "us", "our"), a limited liability company registered in the State of Colorado, United States. By using the Site or purchasing our services, you agree to these Terms. If you do not agree, please do not use the Site.

1. Services

Jhimjham provides software design and development, UI/UX design, website and e-commerce development, branding, and related digital services ("Services"). Services are offered as fixed-price packages described on our Services page or as custom engagements quoted in writing.

Package descriptions on the Site summarise typical scope. The final, binding scope of any engagement is the written scope document or proposal we send you before or shortly after purchase.

2. Orders & Payment

Prices are listed in US Dollars (USD). Packages marked "starting" cover the described baseline scope; additional requirements are quoted separately before work begins.
Payments are processed by a third-party PCI-DSS compliant payment gateway. We never receive or store your full card details.
For custom engagements above $2,000, we may agree on milestone payments (typically 50% to begin and 50% on delivery).
A payment becomes binding when our gateway confirms the charge. You will receive an electronic receipt.
You agree to provide accurate, current and complete information when making a payment.

3. Project Process, Revisions & Client Obligations

Each package includes the number of revision rounds stated in its description. Additional revisions are billed at our then-current rate, agreed in advance.
Project timelines start when we have received (a) payment or the agreed first milestone, and (b) the materials we need from you (content, credentials, brand assets, feedback).
Delays in client feedback or materials extend timelines accordingly. Projects inactive for more than 60 days due to missing client input may be closed; resuming may require a restart fee.

4. Intellectual Property

Upon receipt of full payment, all deliverables created specifically for you transfer to you, including source files where applicable.
We retain ownership of pre-existing tools, libraries, frameworks and know-how used to produce the deliverables, and grant you a perpetual, non-exclusive license to use them within the deliverables.
Third-party assets (fonts, stock images, plugins) remain governed by their own licenses.
We may display completed work in our portfolio unless you request otherwise in writing.

5. Refunds & Cancellations

Refunds are governed by our Refund Policy, which forms part of these Terms.

6. Warranties & Disclaimers

We warrant that Services will be performed in a professional and workmanlike manner. Except as expressly stated, the Site and Services are provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that any website or software will be entirely error-free or uninterrupted, or that it will achieve any particular business result.

7. Limitation of Liability

To the maximum extent permitted by law, Jhimjham's total aggregate liability arising out of or related to any engagement is limited to the amount you actually paid us for that engagement in the six (6) months preceding the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill.

8. Indemnification

You agree to indemnify and hold Jhimjham harmless from claims arising out of (a) content or materials you supply, (b) your use of deliverables in violation of law or third-party rights, or (c) your breach of these Terms.

9. Acceptable Use

You may not use the Site to transmit malicious code, attempt unauthorized access, scrape content at scale, or make fraudulent payments. We may refuse or cancel any order we reasonably suspect to be fraudulent or unlawful.

10. Governing Law & Disputes

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict-of-law rules. The parties will first attempt to resolve any dispute informally by contacting contact@jhimjham.tech. Unresolved disputes shall be brought exclusively in the state or federal courts located in Colorado, and you consent to their jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. The "Effective date" above reflects the latest revision. Material changes will be posted on this page; continued use of the Site after changes constitutes acceptance.
